Islamic law and Roman law - José Aguilera Pleguezuelo

El autor realiza una presentación general del Derecho islámico, señalando sus importantes coincidencias con el romano. Hace una revisión de la escasa historiografía sobre el tema, llegando a la conclusión de que en gran medida hubo una influencia del Derecho romano justinianeo en la regulación de gran número de instituciones de Derecho privado islámico, realizada fundamentalmente a partir del conocimiento del Derecho romano por los juristas musulmanes, fundamentalmente debido a que el Derecho islámico no podía responder a las relaciones jurídicas que se plantearon cuando se amplió el mundo musulmán fuera de Arabia premahometana.

The following article provides a general overview of Islamic Law, noting where it coincides with Roman law. It examines the scant historiography on the subject and concludes that a large number of institutions under private Islamic law were considerably influenced by Justinian Roman law thanks to the knowledge Muslim jurists had of Roman law as a consequence of the absence of Islamic laws covering legal relations, a legal vacuum that arose when Islam expanded beyond pre-Mahometan Arabia.
