The right to paid annual leave scope and its compatibility with the sick leave. Some effects for jurisprudence of the Spanish Supreme Court (case Gerhard Scultz Hoff and others) - Maravillas Espín Sáez

De manera reciente, la STJCE de 20 de enero de 2009 (Caso Gerhard Schultz-Hoff y otros)ha resuelto varias cuestiones prejudiciales planteadas en torno a la posibilidad de compatibilizar las situaciones de suspensión del contrato de trabajo por incapacidad temporal con el ejercicio efectivo del derecho a vacaciones cuando concurren en el mismo espacio temporal. El Tribunal mantiene que un permiso garantizado por el Derecho comunitario no puede menoscabar el derecho a disfrutar de otro permiso garantizado por ese mismo Derecho. Ello supone que podrá disfrutar las vacaciones una vez sea dado de alta, incluso aunque haya terminado el año natural a que correspondían. Igualmente, reconoce el derecho a una compensación económica del trabajador que vea extinguida su relación y no haya podido disfrutar de las vacaciones por encontrarse de baja por enfermedad, aunque se haya superado el año natural en que se devengó el derecho. El propósito del presente trabajo es destacar las claves en las que se funda esta nueva resolución y señalar las implicaciones que sin duda va a tener sobre la configuración actual del derecho a vacaciones en el marco legal y jurisprudencial español.

The European Court of Justice, in joined Cases C-350/06 and C-520/07, has recently decided on some references for preliminary rulings dealing with the possibility to make compatible the sick leave situations with the right to paid annual leave when both of them overlap. The Court maintains that a period of leave guaranteed by Community law cannot affect the right to take another period of leave guaranteed by the same law. It means that the worker will enjoy the right to paid annual leave after recovering from being ill, even if the current year would have finished. The Court also holds the right to an allowance in lieu of the minimum period of paid annual leave when the worker could not exercise his right to paid annual leave because of illness and the employment relationship is terminated, even if the current year would have finished. The purpose of this research is to highlight the key elements on which this ruling is based and to point out the effects on the configuration of the right to paid annual leave within the actual Spanish legal framework.
