La guerra de la Independencia no fue, al menos para la mayoría de los españoles, una confrontación de tipo ideológico. La lucha fue una respuesta a la ocupación en cuanto a tal y así, al tiempo que se rechazaba al invasor, sus innovaciones en materia socio-política eran imitadas por el invadido. Reviste especial importancia, por lo que representó tanto para la seguridad del individuo como para el control del poder del Estado, el tratamiento jurídico del crimen en el nuevo ordenamiento español, de innegable influencia francesa, nacido durante las hostilidades, pues en los textos legales fundamentales se marcaron límites a la actuación de la justicia y se ofrecieron garantías a la libertad e integridad física y moral de la persona.

The war of Independence was not, at least for most Spanish people, an ideological confrontation. The fight was a straight forward response to the occupation. As a consequence, at the same time the invaders were rejected, their socio-political innovations were absorved by the invaded. Of undeniable French influence and born during the hostilities, the legal treatment of crime in the new Spanish order is especially important because of what it means not only for individual security but also for the control of the power of the State, because in its fundamental texts, limits to the action of justice were established as were guaranties to the physical and moral freedom and integrity of the individual.
