El estudio pone en evidencia la peculiaridad del derecho eclesiástico del Estado y explora la incidencia del elemento religioso en los procesos constituyentes o de revisión y de transición constitucional, centrando su análisis en la experiencia de Sudán. El autor observa cómo la referencia al factor religioso reviste un papel ambivalente, en función de la legitimación política y cómo elemento que caracteriza y condiciona la implementación constitucional de los derechos, en la constitutión del 1999 y en la más reciente transición constitucional de Sudán. En particular, el autor analiza el elemento religioso cómo factor de diferenciación y lo significado de la afirmación explícita de la separación entre el Estado y la religión en la constitución interina del Sur de Sudán. Los resultados de la investigatión demuestran los límites de la expansión del constitucionlismo occidental. De hecho, la complejidad de los fenómenos mencionados, impiden una lógica asimilación entre sistemas. Se tendrían que indicar claves de lectura, que en vez de insistir en la perspectiva de la completa homogeneización de la tutela de los derechos, respecten las características individuales de los diferentes países, es decir, en el plan específico de los estudios comparatísticos, orientando éstos últimos (cómo algunas autoridades habían afirmado) hacia una más convincente “comparación por diferencías”.

This study underlines the peculiarity of the analysis of the “ecclesiastical law of the State” and examines the influence of religious factor on constituent processes, constitutional reviews and transitions, focusing on Sudan's question. The Author stresses the double role of religion, as political legitimacy and characterizing and conditioning element for the constitutional establishment of rights in 1999 constitution and in the recent constitutional Sudanese question. Therefore it is considered the relevance of religious factor as an element of differentiation, analysing the meaning of explicit affirmation of the principle of separation between State and religion in the temporary constitution of South Sudan. The inquiry allows to give prominence to the expansion's limits of western constitutionalism. Indeed the complexity of mentioned phenomena prevents an assimilation's logic between juridical systems; it is rather preferable to show readings that don't aim at a complete homogeinity in tutelage of rights' form but respect the specificity of individual Countries. This confirms the necessity and the importance of a "comparison by differences", pointing out by some authors, about the specific area of comparison studies.
