El genotipo y los fenotipos de justicia constitucional en América Latina. (RI §406701)

El objetivo del presente artículo es constatar cómo determinados conceptos desarrollados en otras ciencias pueden enriquecer notablemente el lenguaje y la metodología del derecho comparado. Utilizando los conceptos de “genotipo” y “fenotipo” el autor busca identificar los elementos que confieren una particular identidad a la noción de Constitución para analizar posteriormente la forma como dicha información puede exteriorizarse en textos constitucionales concretos. Bajo estas premisas se procede al análisis de los elementos que conforman el núcleo genético de la justicia constitucional para después observar sus principales manifestaciones estructurales, a efecto de proponer, bajo esta perspectiva, nuevas rutas para el ejercicio clasificatorio. El autor se interesa en destacar, igualmente, aquellos elementos autóctonos que distinguen a algunos sistemas de justicia constitucional de América Latina, a fin de mostrar el desarrollo de rasgos propios que pueden conducir a sostener la existencia de verdaderos modelos a seguir. Finalmente, se analizan las influencias externas que han coadyuvado a enriquecer el sistema mexicano de justicia constitucional.

The article is aimed at determining how concepts developed in different fields of science can be applied to the study of comparative law, thus enhancing its language and methodology. For example, by referring to the concepts of "genotipo" and "fenotipo" the author attempts to identify the elements that confer a private identity to the notion of Constitution. He then analyzes the forms in which this information will be translated in constitutional texts. Under these premises, the author moves on to analyse the elements of the “núcleo genético” of Judicial Review, their main constitutional structure. The author’s aim is to propose, under this perspective, new classifications. Moreover, the author describes a series of peculiarities typical of Judicial Review as carried out in a number of Latin American countries. He then describes how the development of some of these features can support the existence of real models. Finally, the author analyses the external beneficial influences on the Mexican system of judicial review.
