Independencia judicial y composición de los Consejos Superiores de la Magistratura. (RI §406697)

Los Consejos Superiores de la Magistratura surgen en los países de la Europa de Derecho Continental tras la II Guerra Mundial con la finalidad fundamental de garantizar la independencia de jueces y magistrados en el ejercicio de su función jurisdiccional. Para cumplir esta función deviene necesario que tales órganos sean también independientes. Es por ello por lo que la composición de tales Consejos y el modo de designación de sus miembros, constituye un tema esencial. El examen de tales cuestiones en los sistemas jurídico-constitucionales de Francia, Italia y España muestra un panorama poco alentador en este terreno. Es preciso, pues, arbitrar soluciones para que tales Consejos Superiores de Justicia puedan tutelar de manera efectiva el interés general de la independencia del Poder Judicial.

The High Councils of Justice were formed in european countries where Civil Law existed after the World War II with the fundamental purpose of guaranteeing the independence of judges in the exercise of their jurisdictional function. To fulfil this function it is necessarily that such organs are also independent. It is for this reasons that the composition of such Councils and the way in which its members are designated constitutes an key topic. The examination of such questions in the constitutional systems of France, Italy and Spain reveals a rather discouraging panorama in this area. It is therefore necessary to arbitrate solutions in order that such High Councils of Justice can guarantee in an effective way the general interest of the independence of Judicial Power.
