Sobre el valor de la jurisprudencia en Derecho español. (RI §406692)

En el presente estudio, su autor reflexiona sobre el valor y alcance de la jurisprudencia en el derecho español, en un contexto que ancla sus raíces en el modelo revolucionario de finales del S. XVIII, y que experimenta una significativa evolución en etapas posteriores. Para ello, se analiza la posición de Poder Judicial respecto a otros poderes del Estado, y se aborda el fenómeno de la crisis de la ley, con el ascenso paralelo de la Constitución. El estudio final sobre la significación alcanzada por la jurisprudencia en el ordenamiento actual se acompaña de la exposición de una serie de supuestos concretos que evidencian hoy este mayor protagonismo, así como de la reacción del legislador frente a una doctrina jurisprudencial de la que discrepe.

LA POSICIÓN DE LA CONSTITUCIÓN. 4.- UN ANÁLISIS DE LA SIGNIFICACIÓN DE LA JURISPRUDENCIA EN EL ORDENAMIENTO ESPAÑOL. 5.- RECAPITULACIÓN.

The article focuses on the role and scope of case law in the Spanish legal system. The latter, in fact, finds its origin in the revolutionary model of the end of the 18th century, but developed progressively by evolving in stages. The author describes the role of the judiciary and its relationship with the other branches of Government. He then analyses the crisis of statutory law and the simultaneous rise of the Constitution. As a conclusion, he gives empirical evidence of the enhanced importance of case law in the Spanish legal system. Furthermore, he describes how the lawmakers react when dealing with case law they disagree with.
