The interconfederate agreements on collective bargaining (2002-2008): A successful and well established experience - Dulce M.ª Cairós Barreto

Los procesos de negociación colectiva en España han sido dirigidos en los últimos años por Acuerdos de carácter Interconfederal y estatal, de eficacia obligacional que han tenido la doble funcionalidad de determinar las materias que los convenios colectivos de ámbito inferior deben regular, así como de poner cierto freno a los aumento salariales con el objetivo de contener el aumento de la inflación. Este panorama respondía en origen a la necesidad de corregir ciertas disfunciones de la negociación colectiva sin proceder a una reforma legal del sistema.

Lately, the Spanish ordinary collective bargaining has been influenced by Interconfederate Agreements that do not have the collective agreement nature but have anyhow determine the themes to be regulated in the agreements. At the same time, they tried to stop inflation by slowing down salary increases. This practice started with the aim of correcting some dysfunctions of the legal model of collective bargaining instead of proceeding to a legal reform of the system.
