Los planes de igualdad en el Anteproyecto de Ley Orgánica de Igualdad entre Mujeres y Hombres. (RI §406306)  


Plans of equality in the First Draft of Statutory Law of Equality between Women and Men - Gemma Fabregat Monfort

La previsible próxima entrada en vigor de la Ley Orgánica de Igualdad entre Mujeres y Hombres, ha supuesto el retorno a la plena actualidad de la discriminación existente entre unas y otros. Sin perjuicio de que la diferencia de trato entre mujeres y hombres se manifieste en diversos aspectos de la vida diaria, y sin perjuicio, asimismo, de que el Anteproyecto de esa Ley Orgánica de Igualdad entre Mujeres y Hombres (ALOI) aborde el problema desde una perspectiva multidisciplinar, el trabajo se centra únicamente en la discriminación que puede producirse en el concreto momento del acceso al empleo, y más en concreto, se refiere a los planes de igualdad como “novedad” prevista en el ALOI a fin de garantizar la igualdad sustancial entre mujeres y hombres en el momento de la contratación, en un sentido amplio, momento especialmente complicado en lo que aquí interesa dado que la amplia libertad de selección y de contratación del empleador dificulta detectar la discriminación que se produce en ciertas procesos de selección y contratación. Con la intención no solamente de sancionar las discriminaciones cuando son efectivas, que también, sino además con la pretensión de evitar que las conductas discriminatorias continúen perpetuándose en el tiempo, el ALOI contempla planes de igualdad y medidas de acción positiva. Los requisitos a los que cabe condicionar la legalidad de esta dualidad de medidas son dos y ambos concurren en nuestra realidad según la actual doctrina del Tribunal Constitucional al respecto del principio de igualdad y la prohibición de discriminación ex art. 14 C.E.: 1.º) que sea posible desigualar formalmente para igualar sustancialmente; 2.º) que el colectivo al que vayan referidas estas medidas haya sido objeto de una discriminación tal que quede justificada la adopción de esas medidas, aunque la discriminación sufrida sea reconducible a lo denominado como discriminación social. En la medida en que, como digo, esos dos requisitos se cumplen, el ALOI prevé la posibilidad de erradicar la discriminación mediante planes de igualdad. Planes que necesariamente deben adoptarse en convenio colectivo para empresas de más de 250 trabajadores o en caso de que, siendo de más reducidas dimensiones, a la empresa se le haya impuesto la necesidad de pactar este plan como sanción accesoria. Ahora bien, ello no significa que el resto de empresas no puedan negociarlos. Pueden, pero no están obligadas a ello. Las características de estos planes de igualdad, las posibles medidas que como parte de los mismos se pueden negociar, y su continuidad y evaluación son objeto de estudio en el trabajo. Todo ello, sin olvidar que la discriminación en el acceso al empleo incluye la discriminación que puede producirse en el momento de la oferta de empleo, en el momento del proceso de selección y en el de la específica contratación. Y tanto si la razón de ser de esa discriminación es un embarazo real o previsible, como si lo es el mero hecho de ser mujer.

The probably upcoming Spanish Statutory Law of Equality between Women and Men has brought the discrimination existing between men and women back to the spotlight. Notwithstanding the fact that the difference of treatment between women and men is shown in many different aspects in everyday life, and also despite the fact that the first draft of the Spanish Statutory Law Project of Equality between Women and Men (ALOI) approaches the question from a interdisciplinary perspective, this work focuses exclusively that discrimination that may occur at accessing to work. More particularly, that “newness” of equality plans that has been introduced in the ALOI in order to guarantee a substantial equality between women and men at hiring in an broad sense constitutes a specially complicated issue due to the wide freedom of selection and hiring of employers which makes it difficult to detect the eventual discrimination that may take place. With the intention not only to sanction this discriminations when already committed, but also with the aim to avoid the perpetuation in time of such discriminatory conducts, the ALOI assumes the undertaking of plans of equality and measures of positive action. The requirements that permit the legal existence of these two actions are two and they must both be considered simultaneously according to the present doctrine of the Spanish Constitutional Court regarding the principle of equality and the prohibition of discrimination (ex Art. 14 from the Spanish Constitution): 1.º) That it may be possible to misbalance formally to balance substantially; 2.º) That the group referred by these actions has been affected by such a discrimination that the adoption of those measures result in justice, although such discrimination may be considered as social discrimination. As those two requirements are fulfilled, the ALOI anticipates the possibility of eradicating discrimination by means of equality plans. These plans must obligatory be adopted in collective contracts for companies of more than 250 workers, being also the case of companies of smaller dimensions that may have been forced to come to an agreement regarding these plans as a accessory sanction. However, it does not mean that the rest of companies cannot negotiate them: They are allowed to it, but not obliged. The characteristics of these equality plans, the discrimination measures that can be negotiated at the light of the former ones, and their assessment and evaluation are the object of this study. Special attention is drawn to the fact that the discrimination phenomenon at accessing to work includes the formulation of the job offer, the selection process and the eventual hiring, being the underlying reason for that discrimination a real or presumable pregnancy or the mere fact of being woman.
