La Comunidad Europea, la Unión Europea y el Acuerdo con Canadá sobre tratamiento de datos API/PNR: ¿Crónica de la probable denuncia y sustitución anunciadas de un Tratado?. (RI §406121)

El análisis del Acuerdo CE-Canadá sobre el tratamiento de datos AP/PNR, en vigor desde el 22 de marzo de 2006, no puede evitar una referencia central en las negociaciones, el contenido y el destino del previo Acuerdo CE-EEUU de América, cuyo fundamento jurídico comunitario fue anulado mediante sentencia del TJCE de 30 de mayo de 2006 y que, tras su denuncia por la Comisión y el Consejo, fue sustituido posteriormente por un nuevo Acuerdo, ahora con la UE como contraparte. A pesar de que las exigencias de la seguridad frente al terrorismo y del derecho a la vida privada frente a la lucha (por no decir “guerra”) frente al terrorismo encuentran un mejor equilibrio en el Acuerdo CE-Canadá (por ejemplo, método de acceso a los datos, categorías de datos y períodos de conservación, transferencias posteriores, derechos de las personas a las que se refieren o juridicidad de los Compromisos), las instituciones de la UE tienen que tomar nota de que el TJCE ha dado al traste con el marco legal comunitario para la transferencia de datos API/PNR a terceros Estados, diseñado por la Comisión y aceptado por el Consejo. De las implicaciones políticas y jurídicas que se extraigan dependerá la suerte del Acuerdo CE-Canadá. La Comisión y el Consejo tienen ahora diversas opciones y tiempo para decidir.

The analysis of the Agreement between the EC and Canada on the processing of API/PNR data, entered into force the 22nd March 2006, cannot avoid a reference in the negotiations, the content and the destiny of the previously concluded Agreement between the EC and the USA on the processing and transfer of PNR data. This latter Agreement was withdrawn by the Commission and the Council after the judgment of the ECJ of 30 May 2006 had annulled its legal basis in the European Community Law; subsequently, it was replaced by a new Agreement between the EU, instead the EC, and the USA. Even though the Agreement EC-Canada presents a better balanced view of the exigencies of the security in front of the terrorism and of the fundamental rights and freedoms, notably the right to privacy, in front of the fight (not to mention “war”) against terrorism (e.g., method of access to the data, categories of data and periods of conservation, subsequent transfers to other States, rights of the person to whom data relates or legal character of the Commitments), the institutions of the EU must take into account that the ECJ has discredited the legal framework for the transfer of API/PNR data to third States designed by the Commission, allegedly according to the European Community Law and so accepted by the Council. Therefore, the fate of the Agreement between the EC and Canada will depend upon the political and legal implications that are extracted from that judgement of the ECJ. Now, the Commission and the Council have diverse options and time to decide.
