La protección de las minorías religiosas ha conocido un importante impuso en Estados Unidos a raíz de que el Tribunal Supremo Federal aplicara la Religious Freedom Restoration Act en su sentencia Gonzales v. O Centro Espirita Beneficiente Uniao do Vegetal. En este artículo se analiza el contenido de esta norma a la luz de la citada sentencia y de la jurisprudencia norteamericana más relevante en materia de libre ejercicio de la libertad religiosa.

The protection of the religious minorities has been largely improved after the US Supreme Court decision Gonzales v. O Centro Espirita Beneficiente Uniao do Vegetal, in which the Court implicitly held that the Religious Restoration Act of 1993 was applicable at the federal level. This paper focuses on the content of the RFRA and on the merits of the Gonzales decision in the light of the most relevant case law of the US Supreme Court with regard to the free exercise of religion.
