La Ley 40/2007 continúa con la línea reformista de la Seguridad Social de los últimos años pero acentuada ahora con unos objetivos claros: simplificación del sistema, equilibrio entre ingresos y gastos y proporcionalidad entre contribuciones y beneficios. Así, junto a algunos retoques en algunas prestaciones de carácter no contributivo, y en apurada síntesis, la incapacidad temporal vuelve a ser modificada en su duración y en los mecanismos fiscalizadores para evitar abusos y fraudes; los requisitos para acceder a la incapacidad permanente quedan flexibilizados, pero disminuye la cuantía final a obtener en caso de acceder desde la situación de enfermedad común y, en todo caso, establece una nueva fórmula para calcular el complemento de la incapacidad permanente absoluta; se incentiva de nuevo y en mejores términos la prolongación de la vida laboral más allá de la edad ordinaria de jubilación y, al tiempo, se alteran la anticipada y la parcial; en fin, las prestaciones por muerte y supervivencia atienden a la realidad social actual, reconociendo como beneficiario a las parejas de hecho y solventando algunas de las clásicas reivindicaciones.

Law 40/2007 goes on with the reforms on the Social Security System of the last years, but now they are intensified with some clear purposes: to simplify the system, to balance the inputs and outputs and to adjust contributions and benefits. This way, beside little changes in special non-contributory benefits, and with a few words, the temporary incapacity is modificated once more in its duration and in the measures to prevent abuses; the requirements to access to a permanent incapacity pension are more flexible, but the final amount is lower in the case of non-occupational diseases, and the reform sets a new rule to calculate the complement for the absolute permanent incapacity pension; the Law incentives, one more time and in a better way, the extend of the work life and it changes the partial and early retirment pensions; in the end, the death and survivors’ pensions are adequated to the actual spanish society.
