A resultas de las distintas y complejas obligaciones, públicas y privadas, previstas en el ordenamiento de prevención de riesgos, la posición del empresario en el sistema de relaciones laborales lo convierte en absoluto garante de la seguridad y salud de sus trabajadores en el desarrollo de la actividad productiva. Dicha garantía -como contrapunto del derecho a la protección del trabajador- deriva en la necesidad de tomar decisiones adecuadas sobre la identificación de los riesgos y las medidas técnicas de protección, así como adoptar en cada momento las soluciones que se muestren más adecuadas (aún no contempladas en la norma) para evitar en lo posible la producción de accidentes laborales.

EL DEBER DEL EMPRESARIO EN RELACIÓN CON LA CONDUCTA DEL TRABAJADOR.

As a result of the different and complex obligations, public and private, foreseen in the classification of prevention of risks, the position of the businessman in the system of labour relations it is turned by no means by guarantor of the safety and health of his workers into the development of the productive activity. The above mentioned guarantee - as dispute of the right to the protection of the worker - drift in the need to take decisions adapted on the identification of the risks and the technical measures of protection, as well as to adopt in every moment the solutions that prove to be more suitable (still not contemplated in the norm) to avoid in possible the production of accidents at work.
