Application of the fiduciary transaction of the mancipatio fiduciae causa as a guarantee - Javier Belda Mercado

Analizamos en este trabajo lo que representa una forma típica de negocio fiduciario, la transmisión de la propiedad con fin de garantía, que se corresponde con la mancipatio fiduciae causa del derecho romano. La fiducia cum creditore supuso la aplicación del negocio fiduciario de la mancipatio fiduciae causa a la función de garantía crediticia. En este sentido, aquélla constituye una causa negocial común respecto a negocios que pueden genéricamente denominarse fiduciarios. Se trata de una figura cuya historia y evolución no es fácil de describir, y cuya tutela judicial se produce relativamente tarde, parece que por obra del pretor. Precisamente, la fiducia romana ha servido a su vez para la construcción doctrinal y jurisprudencial de los negocios fiduciarios modernos.

This work analyses a typical forma of fiduciary transaction, the transmission of property as a guarantee, which corresponds to mancipatio fiduciae causa found in Roman law. The fiducia cum creditore entailed the application of the fiduciary transaction of the mancipatio fiduciae causa acting as a guarantee for a loan or credit. In this sense, it constitutes a common transactional cause for transactions that can generically be called fiduciary. It is not easy to give the history and evolution of this concept, whose legal regulation came about relatively late, apparently as the work of the praetor. In turn, the Roman fiducia has served for the doctrinal and jurisprudential construction of modern fiduciary transactions.
