Ante el incremento de los llamados matrimonios de complacencia, cuyo fin es obtener beneficios en materia de nacionalidad y extranjería, el presente trabajo analiza las formalidades, tanto civiles como canónicas, que se deben adoptar para evitar su celebración o, en su caso, su posterior inscripción, teniendo en cuenta los modelos de matrimonio que gozan de eficacia civil en nuestro ordenamiento. Los Encargados de los Registros Civiles, así como los Párrocos, deben seguir con rigor estas cautelas en la realización del expediente, en especial la audiencia de los contrayentes, con objeto de prevenir estos matrimonios, en los que hay una ausencia de voluntad matrimonial a pesar de la apariencia externa de matrimonio, por lo que se trata de matrimonios nulos. La finalidad de estas medidas es proteger el ius connubii, tutelar el matrimonio y, en definitiva, la sociedad misma.

Facing the increase of the so called marriages of convenience -those whose goal is to obtain benefits in the fields of citizenship and residence permits- this paper analyses the legal measures, in civil as well as in canon law, that must be adopted to avoid these marriages or, when appropriate, their subsequent registration, taking into account the models of marriage recognized by the Spanish civil law. The Registrars of the Civil Registry Offices, as well as the Parish Priests, must carry out these cautions dealing with marriage proceedings, particularly interviewing the partners, in order to prevent these marriages, which are invalid because of lack of an actual matrimonial will in spite of the external appearances. The goal of these measures is to protect the ius connubii, the institution of matrimony and, ultimately, society itself.
